〔原文〕臣闻廉者,民之表也；贪者,民之贼也.今天下郡县至广 ,官吏至众,而赃污(tī,意思是揭发)发,无日无之.洎(jì,意思是及,到)具案来上,或横贷以全其生,或推恩以除其衅.虽有重律,仅同空文.贪猥之徒,殊无忌惮.昔两汉以赃私致罪者,皆禁锢子孙,矧(shěn,意思是况且)行自犯之乎?太宗朝尝有臣僚数人犯罪,并配少府监隶役.及该赦宥(yòu,意思是宽宥；赦罪),谓近臣曰：“此辈既犯赃滥,只可放令遂便,不可复以官爵.”其责贪残,慎名器如此,皆先朝令罪,固可遵行.欲乞今后应巨僚犯赃抵罪,不从轻贷,并依条施行,纵遇大赦,更不录用.或所犯若轻者,只得受副使上佐.如此,则廉吏知所劝,贪夫知所惧矣.
〔译文〕臣听说：廉吏,是民众的表率；而贪官,则是民众的盗贼.当今天下郡县广布,官吏众多,每天都有官员贪赃枉法的事被揭发出来.等到案件上报官府,自然有人有本事掩盖事实的真相以获得宽刑免罪,因此而保住了性命.另有些人则因获得皇上的恩典而得以减免罪刑.即使律令禁严,也只是一纸空文而已,对贪鄙的官员,不会有丝毫的畏惧.从前两汉时代,那些因贪污而犯罪的官吏,子子孙孙都是严禁作官的,何况是罪官本人?太宗皇帝在位的时候,曾有几个官员犯了罪,后来一起被发配到少府监做仆役.挨到服刑期满时,太宗皇帝对左右的大臣们说：“这些人已犯过贪污罪,只能罢免他们的官职,听其自便,不能再恢复他们的官位.”惩办贪官酷吏、慎重授予官职,就是这样.前朝的典章律令本来应该遵行.在此我请求以后凡是贪赃枉法的官吏被判刑服罪,一律不再从轻发落,应该依据法律条文行事.即使遇上大赦,他们的罪刑被减免,也不录用他们为官.那些犯罪较轻的,最多也只可授予他们副使、上佐之类的无实际执掌的官.这样一来,既劝奖了廉吏,也警示了贪官.
