【摘要】 夫妻财产制度又称婚姻财产制度,是指规范夫妻婚前财产和婚后所得财产的使用、归属、管理、收益,以及夫妻债务的清偿,夫妻家庭生活等费用的负担,婚姻终止时夫妻财产的清算和分割等的法律制度.我国现行婚姻法规定了法定财产制和约定财产制相结合的夫妻财产制度.2001新修订的《婚姻法》虽然就夫妻财产制有了较大的完善,但随着我国市场经济的发展,夫妻财产关系日益复杂.现行的夫妻财产制度不断的显露出他的不足：夫妻法定财产的不足；知识产权归属；约定财产制的不足；个人特有财产不足等等,为了完善我国夫妻财产制度,应当进一步完善夫妻财产制度,构筑我国夫妻财产制度的完整体系.

【Abstract】 Marital property system and said marriage property system,refers to the belongings before marriage and after marriage and regulating the use of property income ownership,management,benefits,and the couple debts,family life,and the burden of expenses,marriage terminated the liquidation and marital property of legal system.Our current regulation legal property system and the combination of marital property system.2001 new castigatory "marriage law" although marital property system has been perfect,but along with the development of market economy in China,the belongings of husband and wife more complicated relationship.Current marital property system constantly reveals his deficiency:a couple of legal property is insufficient;Intellectual property ownership,The agreement; Personal property is not unique to perfect our country,marital property system,should be further perfecting the marital property system in China,the building of the marital property system in complete system.

【Abstract】 Marital property system is also called marriage property system, that means legal system of the criterion of using ,belonging ,adminstration ,yield of the premarital and post marital property ,and settled up the marital debts ,burden of expenditure on family life,the liquidation and carved up marital property when marital termination . State current marriage law have the regulation of marital property system which is combined legal system of property with the agreement of property .Newly-amended Marriage Law in 2001,it made the marital property system has been great improved ,but with the development of market economy in China ,the current marital property system constantly show the probleme like the probleme of legal marital property ,belonging of intellectual property rights ,the probleme of agreement of property system ,the probleme of personal property .For improved the state marital property system ,we should further perfect the marital property system and establish the complete system of state marital property.
