我国刑法中的缓刑,是指对于被判处3年以下有期徒刑、拘役的犯罪分子,根据其犯罪情节和悔罪表现,认为暂缓执行原判刑罚确实不致再危害社会的,给予一定考验期,在考验期内附条件地暂不执行刑罚的一种量刑制度.目前,缓刑制度的适用率不断地增加,诚然已成为司法机关裁判较受欢迎的刑罚制度.事实上在实践中也证明,缓刑制度对教育和改造犯罪分子、让犯罪分子更好地重获新生、预防重新犯罪和维护社会稳定等方面起了重要的作用.然而随着缓刑制度使用率的不断增加,其不足之处也逐渐暴露出来.本文从当今我国缓刑制度存在的问题方面出发,浅论一下完善我国缓刑制度的几点建议.
