本文探讨了当前社会和法学界热议的沉默权问题.在对沉默权的涵义和历史发展作出全面研究的基础上,分析说明了沉默权具有的价值.沉默权的价值体现为对被追诉人的价值和对社会的价值两方面,尤为突出的是给社会带来的平等和程序正义的价值.沉默权也具有负价值,主要是给司法机关指控犯罪造成了困难.针对我国当前对沉默权的否定态度,本文通过结合沉默权的价值理论和我国国情,分析说明了在我国建立沉默权制度利大于弊,我国需要引入沉默权制度.最后对如何建立符合我国国情的沉默权制度发表了看法,提出我国应建立有限的沉默权制度.

The main body of a book silent right problem that fever of having discussed the current society and science of law community discusses.On developing the basis making comprehensive survey to silent right implication and history,analysis has explained the value that silent right has.Silent right value embodies the value being that two aspect,is especially outstanding to the value accusing person and the value to society being pursued is to give equality and program that society brings along justice.Silent right can't have value negative ,be to accuse of committing a crime having brought about difficulty for judicial authority mainly.Specifically for current our country negative attitude to silent right,value theory and our national condition the main body of a book is passed weighing up combining with keeping silent,disadvantage analysis has been explained building silent right system benefit greater than in our country,our country needs to lead into silent right system.The at last has announced view to how to building the silent right system according with our national condition ,has suggested that our country should build limited silent right system.

Abstract
This paper discusses the current social and legal scholars that the right to silence the issue of heat. Right to remain silent in the meaning and history of the development of a comprehensive study on the basis of the analysis shows that the value of the right to remain silent. The value of right to silence has been prosecuted for human values and social values of both sides, especially to the community of the equality and the value of procedural justice. Also has a negative value of the Right to Remain Silent, mainly to the judiciary the difficulties caused by the alleged offender. In view of the current negative attitude of the right to remain silent, right to remain silent in this article the value through a combination of theory and China's national conditions, analysis shows that the establishment of right to remain silent in the system do more good than harm in our country, our system need to introduce the Right to Remain Silent. Finally, how to establish a right to remain silent in line with the system the condition of our country to express their views and put forward our country should be established a system of limited right to remain silent.
