抵押权的实现是指债务人不履行到期债务或发生当事人所约定的情形,抵押权人依法处理抵押物而获得清偿.2007年10月1日起开始实施的《物权法》对于抵押权的实现进行一些改善,相对于《担保法》缩短了担保物权的行使期限；简化了抵押权实现的司法程序,有效的降低了抵押权实现的成本；增加了行使抵押权的前提条件,更加尊重了当事人意思自治的权利,这些改善的好处在实践中是显而易见的,但是对于变换万千的现实社会中,要适应时代的快速变化,若是对《物权法》就满足与此,显然不够的.毕竟《物权法》本身也是存在着诸多的不足之处,譬如法律适用和配套的问题,抵押权实行的方式不够完善,对抵押权实现的时间顺位规定不足等缺陷.本文的建议就是不断的研究与探讨,找出其中的不足之处,加快立法与修改的脚步,不断完善我国的法律体系.
