The definition of counterfeiting is changeable.The Organization for Economic Co-operation and Development study (1998) claim “counterfeiting” as “any manufacturing of a product which so closely imitates the appearance of the product of another to mislead a consumer that it is the product of another.” But under the TRIPS (Trade-Related Aspects of Intellectual Property Rights) Agreement,the expression "counterfeiting" refers only to trademark violations:
(a) “counterfeit trademark goods” shall mean any goods,including packaging,bearing without authorization a trademark which is identical to the trademark validly registered in respect of such goods,or which cannot be distinguished in its essential aspects from such a trademark,and which thereby infringes the rights of the owner of the trademark in question,under the law of the country of importation;
(b) “pirated copyright goods” shall mean any goods which are copies made without the consent of the right holder or person duly authorized by the right holder in the country of production and which are made directly or indirectly from an article where the making of that copy would have constituted an infringement of a copyright,or a related right under the law of the country of importation.

Furthermore,for some people,they don't think that there is much difference between the counterfeit and copyright brands.That poses a tremendous threat to intellectual property.In my country(Draft Amendment to the Trademark Law 30 August 2007) trademark users should be responsible for the quality of the goods on which their trademark is used.The agencies for the administration of industry and commerce at all levels should,through their administration of trademarks,stop acts that deceive consumers.If the government let matters slide,this phenomenon would bring great loss to the producers and would discourage their interests in a market
