由于具有人道性、谦抑性等价值,体现了人文关怀精神,期待可能性理论以“法不强人所难”思想为核心,已在西欧大陆法系国家及日本取得通说地位,并逐步得到立法和司法的认可.我国大多数学者在支持期待可能性理论引进的同时,对于其认定标准、定位等仍众说纷纭.本文拟通过探讨期待可能性理论的理论根基,分析期待可能性理论移植到我国现行刑法体系的必要性、可行性,试图对期待可能性理论移植于我国的实现方式浅谈笔者的看法,即期待可能性理论的本土化.
