2003年7月,最高人民法院、最高人民检察院、公安部、司法部在《关于开展社区矫正试点工作的通知》中确定了京、津、沪、苏、浙、鲁六省市作为全国社区矫正的首批试点省市.笔者从2002年在基层公安派出所工作至今,主要负责公安机关的工作对象管理工作.作为一名基层的执法人员,笔者几乎每天都在与社区矫正对象、街道办事处、乡镇司法所打交道.在当前的社会形势下,笔者对社区矫正这项工作在试点和推进过程中存在的问题和急需改进的地方,无论从制度层面还是实践层面,都有着一定的思考和独到的见解.2009年3月、4月,笔者利用两个月的时间,选取我省济南市、青岛市这两个社区矫正工作开展的比较好的具有一定代表性的城市,进行了深入调研,与许多有实践经验的社区矫正工作者进行了交流和探讨,收集到大量的建议和改进思路.同时对城市和农村的社区矫正对象有选择的进行交谈,实地考察了社区矫正对象的生存状态和改造情况,对如何保障矫正对象的合法权利进行了系统的研究.
本篇论文立足于我国国情,从构建社区主义和谐社会的角度,着重从我国社区矫正的几种形式、现阶段我国社区矫正存在问题以及我国社区矫正制度的改进与完善三个大方面进行论述.
